Terms of service

Last updated October 15, 2026

Draft for legal review. Not yet in force.

These terms are an agreement between ABI GROUP LLC, a Missouri limited liability company ("Club10", "we", "us") and the business that signs up for Club10 ("the customer", "you"). They cover the Club10 software, websites and apps (the "service"). By creating an account or using the service you agree to these terms on behalf of your business.

Members, players and staff who use a club's Club10 site do so under that club's own terms; the club is responsible for its relationship with them.

1. Your account

You must give accurate details when you sign up and keep them up to date. You are responsible for everyone you give access to, for keeping sign-in details safe, and for what happens under your account.

You must be at least 18 and able to agree to these terms for your business.

2. Free trial

New accounts get a free trial of 3 months, with no card required. During the trial the AI assistant is limited to 50 questions a month and club news emails to 500 a month. At the end of the trial you need to choose a paid plan to keep taking new bookings; your data stays in place.

We send reminders before the trial ends. We may change or end the trial offer for new accounts at any time.

3. Plans, prices and payment

Prices and what each plan includes are shown on our pricing page. Plans are billed monthly or yearly in advance in US dollars, through Stripe. Taxes are added where required.

The Academy plan includes 49 courts across all of your clubs; each court in use beyond that is billed at the extra-court price for the current period, adjusted automatically when you add or switch off courts.

AI question packs are one-off purchases, are added to your account immediately, and are not refundable once used.

Bringing your data over from another system ("Move your data") includes free moves for the life of the account: 2 during the free trial, then 2 on the Starter plan, 5 on the Club plan and no set limit on the Academy plan. Each time data is brought in counts as a move, even if it is undone afterwards. After the free moves, a one-off fee buys two more; it is not refundable once a move has been used.

Plan changes take effect straight away and are prorated by Stripe. You can cancel at any time from the billing page; the plan stays active until the end of the period you've paid for. Except where the law requires, payments are not refundable.

If a payment fails we will tell you and retry. If it is still unpaid after [14] days we may limit the service until it is paid.

We may change prices with at least 30 days' notice. A change applies from your next renewal after the notice.

4. Payments you take from your members

Payments from your members go to your club's own Stripe account under Stripe's terms, which you accept directly with Stripe. Club10 takes no commission on these payments. You are responsible for your prices, refunds, disputes, receipts and taxes on what you sell.

5. Your data

You own the data you and your members put into Club10 ("customer data"). We use it only to provide and improve the service, to keep it secure, and as the law requires, as described in our Data processing agreement, which forms part of these terms.

You are responsible for having the right to give us customer data, including telling your members how their data is used and getting any consent the law requires.

You can export your data while your account is open. After an account is closed we delete customer data within [90] days, except what we must keep by law.

6. The AI assistant

The assistant uses an AI model from Anthropic to answer questions about your club and to prepare changes for a person to confirm. Its answers can be wrong; check anything important before relying on it. Nothing the assistant prepares takes effect until one of your staff confirms it. Owners can switch the assistant off for their club.

"Move your data" uses the same AI model to work out what your exported files contain and to read your description of your club. You review everything before it is added, and you can undo an import.

7. Acceptable use

You must not use the service to break the law, send spam, infringe anyone's rights, upload malicious code, test or bypass its security, or put an unreasonable load on it. We may suspend access that puts the service or other customers at risk, and will tell you why where we can.

8. Availability and changes

We work to keep the service available and to fix problems quickly, but we don't promise it will be uninterrupted or error-free. We may improve and change the service; we won't remove a core feature of your plan during a paid period without notice.

9. Third-party services

Some features connect to other services you choose to use, such as Stripe, QuickBooks, Xero or Gusto. Those services are provided under their own terms, and we are not responsible for them.

10. Warranties and liability

Except as stated in these terms, the service is provided "as is" and we disclaim all implied warranties, to the extent the law allows.

Neither party is liable for indirect or consequential losses, or lost profits, revenue or data. Each party's total liability under these terms is limited to the amounts you paid us in the 12 months before the claim. These limits don't apply to your payment obligations or to liability that can't be limited by law.

11. Ending the agreement

You can close your account at any time. We may end these terms if you seriously break them and don't fix the problem within 30 days of our notice, or straight away if the law requires it.

12. General

These terms are governed by the laws of the State of Missouri, and disputes go to the state or federal courts in [Jackson County], Missouri. If part of these terms can't be enforced, the rest still applies. We may update these terms; we'll give at least 30 days' notice of material changes.
